Absolute Latin America – Terms & Conditions

Deposit Payments

A deposit is required in order to begin reserving the client’s services. The deposit amount will usually be 30-40% of the total programme price and can be a higher percentage depending on the number of flights included in the client’s programme. The greater the number of flights, the higher the deposit amount will be as the client’s deposit necessarily includes sufficient funds to purchase all included flights. The remainder of the deposit will cover limited availability transportation tickets, limited availability National Park entry fees, limited availability trek permits, cruise itinerary deposits and accommodation deposits.  

 

Balance Payments

The balance must be paid no later than 70 days before departure.  If balance payment is not received by the appropriate date, the client’s programme will be cancelled and cancellation charges will apply.

If the client books a programme within 70 days of trip commencement, full payment is required. 

 

Changes made by the client

We will do our best to assist the client in altering the client’s arrangements after booking but cannot guarantee this will be possible. If alterations can be made, the client will be responsible for all extra charges and costs and we reserve the right to charge a service fee of US$50/person plus any applicable charges levied by our suppliers.

 

Cancellations made by the client

All cancellations must be received in writing by e-mail. The following charges will apply when cancellation is made after the booking is confirmed by Absolute Latin America:

 

70+ days before departure: retention of deposit

59-30 days before departure: 50% of total price

29 days to 14 days before departure: 80% of total price

Less than 14 days: 100% of price

 

During particular dates such as (but not exclusively) Easter, Christmas and New Year, special policies may apply. In addition to these cancellation fees, deposits required to guarantee hotel space might be non-refundable. Please note that all our penalties above are subject to our suppliers policies and are subject to change. Flights have to be paid in full in order to be confirmed, and are non-refundable. The same fees apply for partial cancellations of a booking.

 

We strongly recommend that full insurance is taken out, which includes cover, under certain circumstances, against the loss of deposit or cancellation charges. Please note that no reimbursements are given when cancellations occur or for any unused services

 

Travel and cancellation insurance

The client’s vacation package with us does NOT include travel insurance and it is the client’s responsibility to ensure the client have adequate insurance cover.

 

Clients’ responsibility

Persons with medical conditions or problems including special diets, allergies, etc. should make them known to Absolute Latin America well before arrival. We reserve the right to disqualify anyone at any time during the tour if it is felt that the individual is physically incapable of performing an activity and/or if that individual’s continued participation would jeopardize the safety of the group or handicap the normal functioning of scheduling of the tour. Absolute Latin America assumes no responsibility for special arrangements necessary or problems experienced for or by passengers physically unable to participate in the planned activities.

 

Clients are responsible for obtaining valid travel documents, complying with customs and other regulations of the country to which they are travelling. Absolute Latin America accepts no responsibility for any problems related to/and or in obtaining these documents.

 

Cancellation or changes made by us

It is occasionally necessary for us to make changes to advertised products and services and we reserve the right to make such changes. In exceptional circumstances we may have to modify the client’s vacation after booking. If the change is minor we will do our best to notify the client in advance but are not obliged to do so and no compensation is payable

 

If the change is material we will notify the client as soon as practically possible and offer the client the choice of accepting the alternative arrangements or arranging an alternative vacation with us or cancelling the client’s vacation.  Unless the client fails to pay the final balance, Absolute Latin America will return all deposits paid or offer an alternative tour of comparable standard and will pay compensation on the scale as shown above. No compensation will be paid if cancellation is due to force majeure or consolidation. Absolute Latin America will not accept responsibility for changes in flight schedule or departure airport, as this is the responsibility of the airline.

Force Majeure

Compensation will not be payable in any cases where an amendment, change or cancellation is due to “force majeure”, being unusual or unforeseeable events or circumstances beyond our control, the consequences of which neither we nor our suppliers could avoid. These include, but are not limited to, war, threat of war, riot, civil disturbance or strife, terrorist activity (actual or threatened), industrial disputes, technical or maintenance problems with transport, machinery or equipment, power failure, natural , fire, flood, drought, adverse weather conditions, levels of water in rivers, acts of God, closed or congested airports or ports, changes imposed by re-scheduling or cancellation of flights by airlines, the alteration of airlines or aircraft types, or similar events beyond the control of Absolute Latin America.

 

Our responsibilities

We take care to ensure that all involved in the preparation and supply of the client’s vacation maintain the highest standards. Please remember that the appropriate standards will be those prevalent in the client’s destination which may not be the same as developed international standards.

 

Absolute Latin America assumes no responsibility to injury, loss, damage to person or property or for additional expenses due to acts of God (sickness, weather, etc.), strike, detention, riot, war, quarantine, thefts, civil disturbances or government regulations or restrictions. We are not responsible for any accidents, delays, inconveniences, expenses or mishaps of any kind whatsoever resulting entirely, or in part, from the negligence of others or from causes beyond our control. We reserve the right to make reasonable changes and/or substitutions in the itinerary where deemed necessary. Baggage is entirely at owner’s risk.

 

All Travel has its own inherent risks, up to and including death and the traveller acknowledges such risks exist. Absolute Latin America is not liable, and the traveller agrees to hold blameless Absolute Latin America, its employees and agents for illness, injury, accident, or death during the tours. Absolute Latin America is not responsible for expenses or harm caused or losses incurred by travellers who (a) disregard of the instructions of our representative(s), (b) depart from the planned activities of the tour, or (c) follow the instructions of a person other than our representative(s).

 

Absolute Latin America will not be responsible for any injury, damage, death, loss, accident or delay due to any act or default of any air, land or water carrier, hotel, restaurant, company or person rendering any of the services, activities or programs included in the tour. Absolute Latin America will not be responsible for the traveller’s cost of travel in returning home before completion of the tour.

 

Flights / Delays

We cannot accept liability for any delays in any of the client’s flights, whether the cancellation or delay is caused by adverse weather conditions, rescheduling of the airline, airport authority and/or action by air traffic controllers, mechanical breakdown or industrial action. Where long flight delays result in lost vacation time, no refunds are given by hotels or suppliers. Similarly, airlines do not offer compensation for flight delays. However, at their discretion, carriers will endeavour to reduce the inconvenience of any delay by providing meals and accommodation, as appropriate for the time of day or night (dependent on local availability). If the client incur payments for such services in the event of a delay, Absolute Latin America will not accept responsibility for payment unless we have given our prior consent.
